1. Delivery:

Home delivery.

1.1 At the Buyer's option, the Goods shall be delivered by a transport company at the Buyer's expense. In individual cases specified by the Seller, the Goods shall be delivered at the Seller's expense.

1.2. The Buyer undertakes to specify the exact place of delivery of the Goods at the time of ordering by selecting the home delivery service. The exact delivery price depends on the weight and price of the Goods ordered. Please see the "Delivery and Collection" section for the current delivery charges.

1.3. The Seller does not provide unloading and loading services for the Goods

1.4. The Buyer's order shall be fulfilled by the scheduled delivery date in the dispatch notice in clause 5.7, except in the case of events beyond the Seller's control (as defined in clause 17 of these Conditions).

1.5. The Goods shall normally be delivered to the address specified by the Buyer. However, the Buyer shall always be informed of the expected delivery date of the Goods by e-mail.

1.6. If more than one Product is ordered, it may be delivered at different times, as it is possible that the Seller does not have the Product in stock and will have it later. No additional transport charge will apply.

1.7. Title to the Goods shall pass to the Buyer from the time the Goods are handed over to the Buyer by the courier. The Buyer collects the Goods from the Seller's employee or the Seller's warehouse. The risk of accidental loss of or damage to the Goods shall pass to the Buyer when the Buyer or a person nominated by the Buyer, other than the courier, accepts the Goods. If the Buyer has chosen the carrier of the Goods and the Seller has not offered such a delivery option, the risk referred to in this paragraph shall pass to the Buyer when the Goods are handed over to the carrier.

1.8. At the time of delivery, the Buyer or, as the case may be, the Buyer's representative, together with a representative of the transport company, shall inspect the condition of the packaging of the consignment in accordance with the rules of the organisation(s) providing courier services.

1.9. In the event of damage to the packaging of the consignment, the Buyer or the Buyer's representative, as the case may be, shall have the right not to accept the consignment. In this case, a representative of the courier service provider shall, together with the Purchaser or, as the case may be, the Purchaser's representative, complete a special consignment inspection report to be submitted by the courier service provider's representative, indicating the irregularities found.

1.10. Once the Buyer or the Buyer's representative, as the case may be, has accepted the consignment and signed the data recorder or the paper delivery note, as the case may be, provided by the representative of the courier service provider without comments, the Goods shall be deemed to have been delivered in the undamaged packaging and the additional services indicated in the data recorder or the paper delivery note shall be deemed to have been duly performed, unless the contrary is proven.

1.11. When the Goods have been delivered and handed over to the Buyer at the address specified by the Buyer, the Goods shall be deemed to have been handed over to the Buyer whether the Buyer receives the Goods or any other person who has received the Goods at the address specified.

1.12. If the Goods are accepted by someone other than the Buyer, the Buyer must provide the details of the person who will accept the Goods when completing the order delivery information.

1.13. A valid proof of identity must be presented when accepting the Goods to identify the Buyer properly. If the Buyer is unable to accept the Goods and the Goods are delivered to the address specified by the Buyer, the Buyer shall have no right to claim against the Seller for delivery of the Goods to the wrong person.

1.14. The Buyer shall, within 14 (fourteen) days from the moment of delivery of the Goods, inspect the packaging of the Goods, the quantity of the Goods, the external quality of the Goods (i.e., whether the Goods are free from any obvious defects in quality) and the range of the Goods. If the Buyer fails to comply with this obligation within the specified period and does not submit any claims to the Seller, the packaging of the Goods shall be deemed to be adequate, and the quantity, external quality, and range of the Goods shall be deemed to be in conformity with the terms of the Contract.

Pick-up from the warehouse.

1.15. At the Buyer's choice, the Goods ordered in the online store may be collected free of charge from the warehouse of UAB Bioenergy LT.

1.16. When the Seller prepares the Goods for collection, the Buyer shall be informed by e-mail and/or SMS and/or phone call that the Goods are ready for collection.

1.17. The normal time limits for the readiness of the Goods for collection shall be as set out in the section "Delivery and Collection".

1.18. The ordered Goods must be collected no later than 3 (three) days after the Seller has informed the Buyer by e-mail or SMS or by phone call that the Goods are available for collection. Failure to collect the Goods within the period specified in this clause shall result in cancellation of the order. In this case, in case of cancellation, the money paid by the Buyer for the Goods shall be refunded immediately, but not later than within 14 days.

1.19. Title to the Goods shall pass to the Buyer on collection from the warehouse when the Seller delivers the Goods to the Buyer.

1.20. On collection of the Goods from the warehouse, the Buyer shall:

   (a) specify the order number;

   (b) provide a valid form of identification.

1.21. Only the Buyer may collect the Goods. If the Goods are to be collected by another person, that person must be named as the recipient of the Goods when ordering the Goods. If the Buyer is a legal person, the Seller shall be entitled to require a power of attorney for the collection of the Goods.

1.22. At the time of collection of the Goods, the Buyer or, as the case may be, the Buyer's representative shall inspect the packaging, quantity, and external quality of the Goods (i.e., whether the Goods are free from any obvious defects in their quality), and the assortment:

   (a) in the event of any damage to the packaging of the Goods, the quantity of the Goods, the external quality of the Goods (i.e., obvious defects in the quality of the Goods), the assortment(s) of the Goods, the Buyer or the Buyer's representative, as the case may be, shall have the right to refuse to accept the Goods;

   (b) upon acceptance of the Goods by the Buyer or the Buyer's representative, as the case may be, the Goods shall be deemed to have been handed over in the correct packaging and to be of the quantity, quality, and assortment of the Goods in accordance with the terms of the Contract.

1.23. Additional information relating to the delivery of the Goods is set out in the section "Delivery and Collection".

2. Price of the Goods and delivery costs:

2.1 The Goods prices will be quoted on the Online Shop. The Seller shall use all reasonable endeavours to ensure that the prices of the Goods are correct when the Buyer places the order.

2.2 Prices for the Goods are subject to change, but such changes will not affect existing Contracts.

2.3 The prices of the Goods are inclusive of VAT (where applicable) at the rate then applicable in the Republic of Lithuania. In the event that the rate of VAT changes between the date of order and the date of delivery, the price may change to reflect the change in the rate of VAT unless the Buyer has paid for the Goods in full prior to the effective date of the change in the VAT rate. The Seller shall inform the Buyer in writing of such price change and shall give the Buyer the opportunity to purchase the Goods at a price adjusted to take account of the change in the VAT rate or to cancel the order. The order shall not be executed until the Buyer's reply has been received. In the event that the Buyer cannot be contacted using the contact details provided by the Buyer, the order shall be deemed to have been cancelled, and the Buyer shall be informed thereof in writing.

2.4 The prices of the Goods do not include the costs of preparation and delivery of the order. The amount of delivery costs indicated in the online shop is subject to change. The rate of delivery costs indicated at the time of placing the order shall apply to the order placed. Please refer to the "Delivery and Collection" section for the current delivery charges.
